Preamble

These conditions are concluded between:

On the one hand, The Company with the commercial name CART-CITY, with status autónomo and NIF number Y3427165H, domiciled at Calle Lope de Vega, 52, BARCELONA, Spain, owner and manager of the electronic commerce site www.cart-city.com, hereinafter referred to as the Site,

On the other hand, People (hereinafter referred to as the "Customer") wishing to make a purchase via The Site.

The purpose of these general conditions is to define the rights and obligations of the parties.

Acceptance of Conditions


The Customer declares to have the capacity to contract under the Conditions described below.
When ordering, the Customer acknowledges having read the general and specific conditions of sale, set out below and declares to accept them without reservation.

Duration


These conditions apply throughout the duration of online services offered by The Site cart-city.com. They can be modified at any time by CART-CITY.
The applicable conditions are those in force on the day the order is placed.

Partial disability


In the event that one of the clauses of this contract is rendered null and void due to a change in legislation, regulations or by court decision, this can in no way affect the validity and compliance by parts of other clauses.

Entire contract


These general conditions of sales and the order summary sent to the Customer form a contractual whole and constitute the entire contractual relationship between the parties. In case of contradiction between these documents, the general conditions of sale will prevail.

Order


The order is made on quote.

Period of validity of the offer, availability


Offers are only valid during their online presentation period and while stocks last. In the event of unavailability of a product after placing an order, the Customer will be contacted by email or telephone in order to be informed and to agree on one of the following solutions:

  • Later delivery of ordered products

  • The delivery of the other available products ordered is made without delay and the missing product will be shipped as soon as possible.

  • Reimbursement of the missing product (s).

  • The partial or total cancellation of the order and its refund.

 

Price

Prices are displayed in Euros (€). Prices “from” are indicative, they have been calculated with a certain quantity and with delivery to a certain point. The exact price will be indicated on the quote. Payment is made in Euro currency (€) only.

VAT

In Spain VAT will be charged at 21% (the current VAT rate).
For the rest of Europe, if your company is registered in the Register of Intra-Community Operators (ROI) the invoice will be free of VAT. You can check with the following link: https://ec.europa.eu/taxation_customs/vies/#/vat-validation
For the rest of the world,
CART-CITY does not charge VAT.

The following mention will be written on all invoices.

Payment

Payment for purchases is made by bank transfer when you make the order confirmation.

The order validated by the Customer will only be considered effective when the bank payment centers concerned have given their agreement. In case of refusal of said centers, the order will be automatically canceled and the Customer notified by email. Payment is made in Euro (€) only.

The invoice send it by emailCART-CITY Company keeps an electronic copy of each invoice.

The CART-CITY company reserves ownership of the products until the Customer has paid the full price for the

Delivery methods


Delivery to the place indicated by the customer at the time of the order.

Shipping cost

Delivery costs, which details appear in the "Delivery" section of the site, are calculated and indicated on the inquiry before the order confirmation.

Delivery Time


The delivery times, which details appear in the "Frequently Asked Questions" section of the Site, are understood to be working days.

CART-CITY company undertakes to deliver the items ordered and paid for by the customer on time. If the said items have not been delivered within 14 (fourteen) days from the scheduled delivery date, for any reason other than force majeure, the sale may be canceled at the request of the Customer. The sums paid by the Customer will then be returned to him. Exceeding delivery times cannot give rise to damages or penalties for delay.

Delay in delivery due to the carrier


Sometimes packages are lost by carriers. In these conditions, the CART-CITY Company will take care of making the necessary complaints to the transporter concerned. Once the complaint and the initiation of an investigation have been completed, it may take 3 (three) to 4 (four) weeks to have the carrier return.

  • If the package is found:

If the package is found, it will be immediately redirected to the Customer's home.

  • If the package is lost:

If the package cannot be found, the Customer may then request the return of the same package (within the availability periods), at the expense of the CART-CITY Company, or the reimbursement of the amount paid. If the product (s) ordered were no longer available at that time, CART-CITY will reimburse the amount of the products concerned by the loss of the carrier. CART-CITY Company will then ask the recipient to provide it with:

  • a certificate on honor indicating the non-receipt of the package with a commitment to refuse the first shipment in the event that it eventually arrives safely.

Customer responsibility & receipt of the package


In case of absence, the carrier will file a first transit advice note. The customer can then reposition the delivery. In the event of a second absence, the package will be returned to our warehouse. After checking the intact package, the goods will be refunded. Shipping costs will remain the responsibility of the customer.

Customer Liability & Damaged Packages


The Customer is required to check the condition of the package and its content (damage, missing item compared to the order form, damaged or opened package, broken item, apparent defect, non-compliance, etc.) before signing the delivery slip. , otherwise the Company would not be able to reimburse the damaged product (s).

In the event of a missing item and / or damage, the Customer must imperatively file a complaint, within 3 (three) days of receipt of the package, in writing (Email or Registered letter with acknowledgment of receipt) to our services and those of the transporter. After this period, the products delivered will be deemed to be in conformity and free from any apparent defects.

CART-CITY Company will carry out any useful checks and will request the Customer, if necessary, to request all information or useful photos. CART-CITY may then decide and respond favorably or unfavorably to the requests of the Client.

Please note: No product return or replacement can be accepted if the product has been used.

Reference error


If the Customer finds a reference error in his order (for example: color different to that ordered) he must inform our services by email within the number of days mentioned by the law of its country from the date of delivery. CART-CITY will then cover the shipping costs.

Before returning all or part of his order, the Customer must request authorization to return online by email to CART-CITY and send the photos necessary to justify the dispute.

The Customer must keep the proof of deposit of the package which will be given to him by post. In case of loss of the package, no refund will be made without this proof.

The return will be made by the company CART-CITY, the Customer must make available the disputed product (s) and package them and inform the company CART-CITY of the dimensions of the packaging, weight, address, contact and timetable for picking up the goods. .

Package return - Wrong address


The Customer must verify the accuracy of the postal coordinates he provides. CART-CITY cannot be held responsible for any data entry errors or omissions and the consequences in terms of delay or delivery error. All re-shipment costs will be borne by the Customer.

Retraction


In application of the Consumer Code, the Customer has a period of days mentioned by the law of its country, from the receipt of his order to exercise his right of withdrawal and return all or part of his order.

The CART-CITY Company undertakes to reimburse the Customer, with the exception of the shipping costs which remain at its expense, provided that the items returned comply with the return conditions mentioned below (see Status of items).

Before returning all or part of their order, the Customer must request authorization to return online by email to CART-CITY.

The Customer returns or returns the goods to the trader at the latest within this number of days of the communication of his decision to withdraw, unless the trader offers to collect the goods himself (article L. 121-21-3 al . 1 of the Consumer Code).

The Customer must keep the proof of deposit of the package which will be given to him by post. In case of loss of the package, no refund will be made without this proof. The reimbursement takes place within a maximum period of 14 (fourteen) days after receipt of the package.

The return will be made to the address indicated by the seller.

Status of items


Returned products must be perfectly intact, that is to say contents and container of origin perfectly sealed, with the instructions and accessories if necessary. Upon receipt of the package, the CART-CITY Company will judge the perfect condition of the returned goods. No return will be accepted if the returned items have been visibly used, damaged by the Customer and this damage makes the items unfit for sale.

If the return is refused, the articles will then be returned to the Customer at the expense of CART-CITY Company without the customer being able to demand any compensation or right of reimbursement.

In the event of a package return whose content does not comply with the return request or whose articles do not comply with the return conditions mentioned above, the CART-CITY Company reserves the right to exercise any action corresponding recovery from the client.

Guarantee


All products offered by CART-CITY are guaranteed for 2 years.

The Customer has a period of 3 (three) days from delivery to form any reservations or complaints for non-compliance or apparent defect of the items delivered, by email or by registered mail with acknowledgment of receipt to the following address :

After this period and failing to comply with this formality, the articles will be deemed to be in conformity and free from any apparent defects and no claim may be validly accepted. CART-CITY will carry out any useful checks and will request the Customer, if necessary, to request any information or useful photos.

If the lack of conformity of the article is proven, The CART-CITY Company undertakes to replace the article at its expense or to reimburse the Customer as soon as possible. The reimbursement takes place within a maximum period of 30 (thirty) days after receipt of the return of the package. In the event of re-dispatch of the goods to the warehouse of the CART-CITY Company, the return will be made to the following address accompanied by the return slip: CALLE LOPE DE VEGA, 52 – 08005 BARCELONA, SPAIN

The Customer must keep the proof of deposit of the package which will be given to him by the carrier. In case of loss of the package, no refund will be made without this proof. The CART-CITY Company cannot be held responsible for the misuse and / or inappropriate use of the products that the Customer may make of it.

Force majeure


The manufacturer of the products cannot be held responsible for the total or partial non-execution of the contract, if this non-execution is caused by a fortuitous event or a case of force majeure.

Will be considered fortuitous or force majeure: total or partial strikes, internal or external to the company, the blocking of the means of transport or supply for any reason whatsoever, government or legal restrictions, breakdowns of computer, earthquakes, fires, storms, floods, lightning, shutdown of communication networks.

In the presence of such an event, the CART-CITY Company will notify the Customer within 10 (ten) days of the occurrence or threat of this event (except incapacity due to force majeure) in order to agree on the conditions under which the performance of the contract will be continued.

If the case of force majeure lasts longer than a month, the CART-CITY Company, which cannot honor the order, may reimburse it at the request of the Customer.

Disputes, Applicable law


The applicable law of this contract is Spanish law. The language of this contract is Spanish. In the event of a dispute, the Customer will first contact the CART-CITY Company to find an amicable solution.
Otherwise, the case will fall under the exclusive jurisdiction of the courts of the CART-CITY headquarters.

Protection of personal data


Nominative information

The data collected is intended for the use of CART-CITY, it is necessary for the processing and management of Customer orders as well as for commercial relations between the Site and the Customer. They also allow the Site to provide the Customer with personalized services and to improve the relevance of the information offered to them.

CART-CITY may also offer its visitors, Customers, to receive promotional offers from its partners.

CART-CITY may transmit the identity and contact details of its users or customers to commercial partners, only to the extent that they have agreed to the disclosure of their personal data.

Users or customers can change their choice at any time by sending an email to CART-CITY.

Right of access and rectification


In accordance with the law of January 6, 1978, the user has the right to access, rectify, modify and delete data concerning him. The user can expressly object to the disclosure of his contact details. To do this, simply report it by email to CART-CITY.

Intellectual property

No one is authorized to reproduce, exploit, distribute or use for any reason whatsoever and even partially elements of the site, whether software or visual, without the prior written authorization of the CART-CITYCompany.

Simple or hypertext links must be subject to the prior written agreement of CART-CITY.
